The work we do
If you are unmarried and going through separation, we can provide you with:

- Can draft a Separation Agreement for you.
- Advice regarding the property which you may co-own or which you may not own but have paid money towards and believe you have a beneficial interest in
- Advice regarding forcing a sale of a co-owned property
- Advice regarding defending a potential claim made by someone in respect of a beneficial interest they may have in your property
- Advice in respect of financial provision for children of the relationship under Schedule 1 Children Act 1989
Property Ownership and Unmarried Couples:
These are often called a “Tolata” claim after the relevant law which is the Trust of Land and Appointment of Trustee Act 1996.
There are three common scenarios.
- Firstly, an unmarried couple buy a house together and then separate.
- Secondly, an unmarried couple live in a property owned by just one of them.
- Thirdly, there are children.
“Tolata” claims can be made after the property is sold as it covers disputes about the proceeds of sale as well. Our experts can guide you through this often complicated process. Please contact us on [email protected] if you would like to arrange an initial appointment.
