Property Ownership and Unmarried Couples:

These are often called a “Tolata” claim after the relevant law which is the Trust of Land and Appointment of Trustee Act 1996.

There are three common scenarios.

  1. Firstly, an unmarried couple buy a house together and then separate.
  2. Secondly, an unmarried couple live in a property owned by just one of them.  
  3. Thirdly, there are children.
